Financial Safeguards, EMD & Performance Security Guarantees
The procurement dossier for the Auditonline recruitment contract mandates stringent financial parameters in accordance with GFR 2017 and GeM guidelines. The estimated contract valuation must be realistically benchmarked against market rates to ensure value for public money. Bidders are required to submit an Earnest Money Deposit (EMD) fixed at 2 percent of the estimated cost to deter frivolous bids, payable via demand draft, banker cheque, or bank guarantee. Upon successful award, the lowest responsive bidder (L1) must furnish a Performance Bank Guarantee (PBG) ranging from 3 to 5 percent of the total contract value to secure performance obligations. A nominal, non-refundable tender document fee is levied where applicable. Furthermore, a strict Liquidated Damages (LD) clause is enforced, levying 0.5 percent of the delayed milestone value per week of delay, capped at a maximum of 10 percent of the total contract price, ensuring rigorous adherence to project delivery timelines.
General Conditions of Contract (GCC) & Integrity Compliance
Contract compliance is governed by the General Conditions of Contract (GCC), ensuring strict adherence to timelines and quality benchmarks. Dispute resolution is mandated through arbitration under the Indian Arbitration and Conciliation Act, with an independent sole arbitrator appointed by Auditonline. Payments are structured through milestone billing tied to verifiable recruitment deliverables. A Defect Liability Period (DLP) is enforced to rectify any discrepancies post-execution. Additionally, an Integrity Pact is mandatory for high-value contracts to maintain transparency, deterring corrupt practices throughout the procurement lifecycle.
Procurement & Bidding FAQs — Auditonline N/A Recruitment
Unless explicitly stated otherwise in the Special Conditions of Contract, Joint Ventures and Consortiums are generally not permitted to bid, ensuring single-entity accountability and direct contractual responsibility.
The EMD Bank Guarantee must be issued by a scheduled commercial bank in India, strictly adhering to the pro-forma provided in the tender document, and must remain valid for 45 days beyond the final bid validity period.
Bids must remain valid and open for acceptance for a minimum period of 180 days from the last date of bid submission, during which no price escalations are permitted.
Given the nature of recruitment and manpower services, statutory revisions in minimum wages, EPF, and ESI contributions will be reimbursed at actuals, provided valid documentary proof is submitted.
Bidders must secure a minimum technical score of 70 marks out of 100 during the Quality and Cost Based Selection (QCBS) or technical evaluation stage to qualify for the commercial bid opening.
Registered MSMEs holding valid UDYAM certificates covering the scope of work are exempt from paying the EMD and tender document fee, provided they submit requisite valid documentation during bid submission.
